Over the years, a home—and the land it stands on—may go through several ownership changes. The “chain of title” describes the history of ownership and lists each person or entity that once owned the land and/or building. Our goal is to provide the customer with a title commitment within 3 business days of a request so that the customer knows if there are any title matters that need attention prior to closing.

Title insurance protects the lender and owner from unexpected problems in the chain of title. The insurance covers problems that occurred prior to the closing, butare discovered after the closing. For example, there may be unpaid real estate taxes or other liens. When the title was transferred in the past, someone may have forged a signature or written an improper property description. Or there may be certain types of easements on the property that were not discovered in the title search.  Title insurance covers the insured party for any claims and legal fees that arise out of such problems.

Sometimes a customer does not require a complete title search but only requires an “Owners search”. With this type of search we look only at what is on record since the current owner purchased the property. This type of search should not be used in a purchase transaction but may meet the customer’s needs, for example, when offering a home equity loan. Please call for costs and reporting requirements if you are interested in this product.

This is an example of when an Owners Search may meet customer’s needs.  Maine law requires municipalities to follow specific procedures when conducting a tax lien foreclosure. We can help reduce a municipality’s time and effort by providing a report with the statutorily required information to make the process proceed smoothly each time.
